The Smithsonian Institution is committed to an "Open Access" content policy and says:

"We invite you to download, share, and reuse our open access assets for art and creative projects, education, scholarly research, digital media projects, publications, merchandising, and more - all without charge or restrictions from the Smithsonian."

Some content is published with a "Creative Commons Zero" licence, meaning there are no restrictions on re-using it. For the rest, it can be used for uses consistent with the principles fair use under Section 108 of the U.S. Copyright Act, where the use must "cite the author and source of the Content as you would material from any printed work" and "Cite and link to, when possible, the Website as the source of the Content".
